1. Introduction

These Terms and Conditions govern your use of our travel website and any services provided through this site. By accessing our website and using its services, you agree to these Terms and Conditions in their entirety.

2. Services

Jinn Limited provides travel tour services, including booking, consultation, and information provision. We reserve the right to modify or suspend any services on our website without prior notice.

3. Contract Terms

3.1. Company Information
Your contract is with Jinn Limited (hereafter “Company”). In this document, “we”, “our”, or “us” refer to Jinn Limited. Our website address is: https://jinn-travel.com. We are a company registered in Hong Kong Special Administrative Region of China, with company number 76850930. Our registered address is Unit B, 11/F, 23 Thomson Road, Wan Chai, Hong Kong SAR China.

3.2 The Client
The client or “you” – The person whose signature and details appear on the booking form.

3.3 The Contract
The contract consists of:

These conditions of contract.
The specific itinerary for the tour on which the client has booked.
The application booking form.
All of these elements are incorporated into and shall constitute the entire contract made between the Company and the Client.

3.4 Date of Departure
The Date of Departure refers to the commencement date of the tour.

3.5 Force Majeure
Force Majeure refers to unusual and unforeseeable circumstances beyond the control of the Company, the consequences of which could not have been avoided, even if all due care had been exercised.

4. Booking Form and Administrative Fee

4.1 To book an escorted tour with Jinn Limited, the Client must submit a completed booking form and pay a minimum administrative fee of €200 for private tours or €600 for group tours per person.

4.2 In some cases, we may contact you for additional interim payments if certain services, such as flights, need to be secured in advance.

4.3 The Contract between Jinn Limited and the Client will be considered final and binding on both parties from the date that notification of the acceptance of the administrative fee has been sent by the Company to the Client. 

4.4 We reserve the right to return the deposit to the client and decline the acceptance of the client’s application for any reason. The Contract is subject to the following terms and conditions.

5. Balance of Payment

5.1 The client is required to settle the remaining balance of the tour price at least 30 days prior to the departure date. If the booking is made within 30 days of the departure date, the full tour price must be paid at the time of booking.

5.2 For international payments, the client must ensure that the complete EUR amount is received by the Company after all applicable bank fees have been deducted.

6. Failure to Pay the Balance of Payment

If the outstanding balance of the tour price is not received by the Company at least 30 days before the departure date, we will consider the Contract as canceled by the Client. In such cases, the deposit will be retained by the Company.

7. Passports, Visas, and Health Matters

It is solely your responsibility to arrange medical vaccinations, obtain passports, and secure any necessary visas before departure. The Company cannot be held liable for any cancellation of your trip if you are denied boarding or unable to continue the tour due to issues with your travel documents. If you are unable to travel because you cannot obtain or do not possess the appropriate visa, we reserve the right to retain the cost of the trip.

8. Cancellation and Refunds

In the event of a cancellation by the client, the following conditions apply:

  • Cancellation more than 30 days before the tour starts: full refund, excluding the administrative fee.
  • Cancellation 30 days or less before the tour starts: 50% refund of the tour price, excluding the administrative fee.
  • Cancellation after the tour has started: no refund.

All cancellations must be made in writing by the person who signed the booking form. The client acknowledges that the payment for the tour is an integral part of the tour’s income, covering expenses for equipment, operations, staff, and administration. The Company incurs a significant portion of its costs before the actual departure date.

If the tour is canceled by the client after the departure date, no refund will be given for any unused portion of the tour or services. If the client voluntarily makes changes to the tour or departs from any part of it, all related costs and liabilities will be the responsibility of the client. The client must promptly notify in writing the reason for leaving the tour.

Force Majeure: In the event of unforeseen circumstances beyond our control, such as pandemics, natural disasters, political unrest, or government-imposed travel restrictions, Jinn Travel reserves the right to modify, postpone, or cancel tours. Refunds for cancellations due to force majeure events will be subject to our standard cancellation policy, but we will make every effort to offer flexible rebooking options or alternative solutions. We strongly recommend that all travelers obtain comprehensive travel insurance covering such scenarios.

Refunds will be processed within 30 days after a cancellation request is approved.

9. Cancellation by the Company

9.1 We reserve the right to cancel your tour. However, we typically do not exercise this right unless compelled by unforeseen circumstances such as flight cancellations, civil or political unrest, “force majeure,” or if minimum group numbers are not met for group tours.

9.2 If we cancel the tour, we will offer you an alternative tour of equivalent or lesser value. Should this alternative not be acceptable, we will refund all payments made to the Company regarding the tour, excluding non-refundable deposits and airfares. However, we are not liable for any incidental expenses you may incur due to the cancellation or for any other losses or damages resulting from the cancellation.

9.3 The Company will set a minimum number of participants required for the tour to proceed and will inform you at least 30 days before the departure if the minimum number has not been reached, resulting in the cancellation of the tour. In such cases, all payments made to the Company will be refunded.

9.4 If a flight cancellation by an airline leads to the tour’s cancellation, the Company will only refund the amounts that can be recovered. It is the Client’s responsibility to have appropriate insurance to cover any additional losses.

10. Travel Advisory and Safety Information

10.1 The Client is responsible for obtaining and reviewing travel advisories and safety information from the Hong Kong Security Bureau and the Immigration Department, or other relevant authorities. It is essential for the Client to be aware of the latest updates regarding the safety of their travel destinations and to make informed travel decisions accordingly.

10.2 While we will make efforts to keep clients informed about any major changes in travel advisories, it remains the Client’s responsibility to consult the latest travel advice from the Hong Kong Security Bureau or other official sources for their destination. The Company is not liable if the Client a) cancels their booking based on travel advisories or b) does not have adequate travel insurance. Generally, the Company will not cancel a tour solely based on travel advisory recommendations.

11. Transfer of Booking by the Client

It is solely your responsibility to arrange medical vaccinations, obtain passports, and secure any necessary visas before departure. The Company cannot be held liable for any cancellation of your trip if you are denied boarding or unable to continue the tour due to issues with your travel documents. If you are unable to travel because you cannot obtain or do not possess the appropriate visa, we reserve the right to retain the cost of the trip.

12. Changes by the Company

12.1 While it is unlikely that the Company will need to modify our published itineraries, please note that all arrangements are planned well in advance. Occasionally, adjustments may be necessary without prior notice, and the Company reserves the right to make these changes at any time. The published itinerary is intended to serve as a general outline of the planned tour and does not create a binding contractual obligation for the Company.

12.2 The Client acknowledges that the nature of the tours offered by the Company requires a certain degree of flexibility. Consequently, the content and timing of the tour (including arrival times at destinations, route changes, or alterations in transportation methods) may be significantly affected by factors such as Force Majeure, weather conditions, local political situations, natural disasters (like landslides, earthquakes, or severe flooding), strikes, border issues, mechanical failures, flight cancellations, illness, or other unforeseen events. The Client must be prepared to accept these necessary changes and understand that the Company cannot be held liable for delays, alterations to the schedule, or any related expenses.

12.3 If a major change becomes necessary before the tour departs, the Company will notify the Client at their last known address (via email or post) as soon as possible after becoming aware of the change.

12.4 If a significant alteration to the itinerary is required prior to the start of the tour—such as a date change—the Client will have the option to either accept the modified arrangements, choose another available tour from the Company, or cancel the tour for a full refund, provided the change is not due to flight cancellations, civil or political unrest, Force Majeure, or any other situation beyond the Company’s control. The Client must make this decision within 14 days of being notified.

12.5 However, the Company reserves the right to alter the itinerary after the tour has begun, without offering a refund, if such changes are deemed to be in the best interest of the Client. No refunds or compensation will be provided for any unused hotel accommodations, airline tickets, or other services not utilized during the tour.

13. Disclaimer: Company and Client Responsibility

13.1 The Client’s booking is made with the understanding that they accept the potential risks and inconveniences that can be involved in such tours, including injury, loss or damage to property, discomfort, and inconvenience.

13.2 Mode of Transport: For each tour, Jinn Limited uses locally arranged transport, which may include jeeps, buses, trains, rivercraft, or helicopters as specified in the tour itinerary.

a) The Company’s responsibility to the Client is selecting competent, independent subcontractors to provide reasonable transport under local conditions and any other services related to the Tour, exercising due care in selecting such suppliers.

b) The Client agrees that safety standards in developing countries may differ from those in CIS countries, and that items such as seat belts may often be unavailable.

13.3 Accommodation: We strive to provide interesting and safe accommodations, but the Client’s booking is accepted with the understanding that safety standards in developing countries may differ from those in Hong Kong, and that features like fire escapes may often be unavailable.

13.4 Where the Client does not suffer personal injury, and the issue is not due to “Force Majeure,” the Company accepts liability if any part of the tour arrangements booked with the Company are not provided as described in the itinerary. However, the Company does not accept liability for compensation if the failure in tour arrangements was not the fault of the Company or its suppliers and was due to the Client’s actions, the actions of someone unconnected with the tour arrangements, or unforeseen circumstances that could not have been avoided even with due care. The same rules apply if the Client suffers personal injury or death due to an activity forming part of the tour arrangements booked with the Company.

13.5 Our responsibility begins when you meet the group at the designated start point overseas, usually the airport in the city where the trip starts. We are not responsible for any additional expenses you may incur in getting to the meeting point.

14. Group Trips

The Company will designate a Tour Leader(s) who will act as the representative of the Company during the tour. The Client agrees to comply with the decisions made by the Tour Leader, who will have full discretion and authority to ensure the proper execution of the Company’s responsibilities as outlined in the Contract. If, at any point, your physical condition or behaviour negatively impacts your own well-being or that of other group members, the Tour Leader reserves the right to remove you from the tour without entitlement to a refund or any form of compensation.

15. Adherence to Local Laws

The Client is responsible for ensuring compliance with all relevant laws, visa requirements, and immigration, customs, and foreign exchange regulations of the countries visited, at their own expense and liability. If the Client fails to comply with or violates any such laws, requirements, or regulations, the Company reserves the right to require the Client to leave the tour. In such a case, no refund or other compensation will be provided.

16. General Conditions

16.1 No individual, except with the explicit written permission of a Director of Jinn Limited, has the authority to waive or modify any of these conditions.

16.2 The Client confirms that, prior to entering into the Contract, they have been provided with general information on passport and visa requirements for the tour, as well as the necessary health formalities, and are aware of no reasons that would prevent them from complying with these requirements.

16.3 This contract shall be governed by Hong Kong law, and both parties irrevocably agree to submit to the exclusive jurisdiction of the courts of Hong Kong for the resolution of any disputes arising out of or in connection with this contract.

17. Consumer Rights

Consumers have the right to receive clear information about our services, cancellation policies, and refund procedures as per the Consumer Goods Safety Ordinance and the Trade Descriptions Ordinance in Hong Kong, as well as international consumer protection standards.
